Justice Sandra Day O'Connor seemed skeptical of the Bush administration's claim that the tea can be banned, but she may not be around to vote in the case.
About 130 members of a Brazil-based church have been in a long-running dispute with federal agents who seized their tea in 1999. The hoasca tea, which contains an illegal drug known as DMT, is considered sacred to members of O Centro Espirita Beneficiente Uniao do Vegetal.
The Bush administration contends the tea is not only illegal but potentially dangerous.
The Supreme Court has dealt with religious drug cases before. Justices ruled 15 years ago that states could criminalize the use of peyote by American Indians. But Congress changed the law to allow the sacramental use in tribal services of peyote, a bitter-tasting cactus that includes the hallucinogen mescaline.
O'Connor pointed out during Tuesday's argument that Congress changed the rules. She interrupted the Bush administration lawyer in his opening statement and peppered him with difficult questions.
Other justices also seemed concerned by the government's claim that an exception could be made for peyote, but not for hoasca tea.
"That is a rather rough problem under the First Amendment," said Justice Stephen Breyer.
Justice Antonin Scalia, who wrote the 1990 peyote opinion, said tribes have been using peyote - "a demonstration you can make an exception without the sky falling."
Hallucinogenic tea and a falling sky. It all fits together.

True, DMT in and of itself does not have that effect. Deriving it from plant sources, and coupling it with other plants containing MAOIs (preventing the breakdown of DMT in the digestive tract) has a wide range of side effects. Smoked DMT does only last a few minutes, but ayahuasca is a different breed of animal. Best to stick to cubensis.
Oddly enough, banning the plants commonly used to make this stuff would be of little consequence. Any person with enough knowledge can walk into a forest and find plants containing DMT, it's not uncommon.

Nope, the active compound in Salvia (Salvinorin) is unique to that mint.

I never tried Salvia (and probably never will), however I did have a pretty rough experience last time I tried mushrooms (1975).
We used to pick cubensis in the cow pastures of north FL (around Jacksonville) where they grew in abundance. We would chop them up, boil them (they did grow in cow shit) , let the solids settle and pour off the clear liquid. To this we would add Welches Instant Frozen Limeaid to try (it didn't work) to cover the taste.
Contrary to what some people claim, you can trip balz™ on them. In addition to visual and auditory hallucinations, they can induce a nasty pass out which is followed by waking up not knowing (1) who you are, (2) where you are, (3) what you are doing, (4) who the people around you are, etc. Recovery time is around one minute from the full system reset, if you are lucky.
Oh no, no, no I don't do that no more.
I'm tired of waking up on the floor.....

There is not much to "enjoy" about salvia (it's extremely powerful, but not fun in the conventional sense). That's probably why it's not scheduled. Doing so would just bring more attention to it than it deserves.
